Welcome to IRCHAD, a platform and app designed for touristic and travel agencies, developed by Sefrone, an Algerian software development company. These Terms of Service ("Terms") govern your use of the IRCHAD app, website, and related services (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.



1. Acceptance of Terms

By using IRCHAD, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding agreement. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.



2. Description of Services

IRCHAD provides the following Services:

  • Touristic and Travel Agency Platform: Tools for managing bookings, itineraries, customer information, and travel packages.
  • Customer Management: Features to manage client interactions, reservations, and payments.
  • Related Services: Customer support, analytics, and other features to enhance your experience.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.



3. User Responsibilities

As a user of IRCHAD, you agree to:

  • Be at least 18 years old to use our Services.
  • Provide accurate and complete information when required.
  • Use the Services only for lawful purposes and in compliance with these Terms and applicable laws in Algeria.
  • Not engage in any activity that disrupts or interferes with the functioning of our Services.
  • Not attempt to gain unauthorized access to our systems or data.

All intellectual property rights, including but not limited to software, trademarks, logos, and content, are owned by Sefrone or its licensors. You are granted a limited, non-exclusive, non-transferable license to use IRCHAD in accordance with these Terms. You may not copy, modify, distribute, or create derivative works without our prior written consent.



5. Booking and Payment Services

If you use IRCHAD's booking and payment services, you agree to:

  • Provide accurate payment and booking information.
  • Comply with all applicable laws and regulations related to travel, tourism, and electronic payments in Algeria.
  • Be responsible for any fees, taxes, or charges associated with your transactions.
  • Acknowledge that we reserve the right to change pricing at any time, with notice to users.

IRCHAD is not responsible for any disputes between you and third-party service providers, such as airlines, hotels, or payment processors.



6. Content and Listings

If you use IRCHAD to list travel packages, tours, or other services, you agree to:

  • Comply with all applicable laws and regulations related to tourism and travel in Algeria.
  • Be responsible for the accuracy, quality, and legality of the content you provide.
  • Ensure that your use of IRCHAD does not infringe on the rights of others.

IRCHAD reserves the right to remove any content or suspend your account if we believe it violates these Terms or applicable laws.



7. Privacy Policy

Your use of IRCHAD is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in our Privacy Policy.



8. Limitation of Liability

To the fullest extent permitted by law, Sefrone shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of IRCHAD. Our total liability for any claims under these Terms shall not exceed the amount you paid to us for the Services in the past six months.

Our Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free services.



9. Indemnification

You agree to indemnify and hold Sefrone harmless from any claims, damages, losses, or expenses (including legal fees) arising out of your use of IRCHAD, your violation of these Terms, or your infringement of any third-party rights.



10. Termination

We reserve the right to suspend or terminate your access to IRCHAD at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use our Services will immediately cease.



11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Algeria. Any disputes arising out of or related to these Terms or your use of IRCHAD shall be resolved through negotiation, mediation, or arbitration in Algeria, as required by Algerian law.



12. Amendments

We reserve the right to update these Terms at any time. Changes will be posted on our website or within the IRCHAD app, and your continued use of our Services constitutes acceptance of the updated Terms.
